Child Custody & Modifying A Court Order

Follow Us

Children of divorced parents have it tough sometimes, and child custody can be the hardest part of a divorce case to mitigate. Emotions run high, and when one parent’s situation isn’t favorable to a child’s well-being, that parent can be separated from their children even when the bond between them is a very strong one.

But situations can change in life, and often do. A parent who was granted limited visitation or custody can improve their living conditions in a number of ways that may be important to consider – a new job, a new home, a better living environment for their children. In a situation like this, it is important to reevaluate the Custody Order and reconsider just how custody should be redistributed so that the child’s best interests are served.

According to California Family Law Code Section 3011, “the health, safety, and welfare of the child” are the most important factors to consider in any custody case. When your living conditions are better suited for supporting these things, then your limited visitation should be increased to partial or joint custody, so that your children have access to both their parents.
