Dependency exemptions and divorce

California taxpayers are allowed two types of exemptions:  1) personal and, 2) dependency.

When it comes to divorce, one of the most common tax questions asked is, “Who gets to file for the Dependency Exemption?”  In most cases the custodial parent is entitled to claim a child as an exemption although he or she has the right to waive this entitlement.  Both parents are not allowed to claim the same child.

A second very important tax issue is the Child Tax Credit, which is worth as much as $1,000 per qualifying child under 17 depending upon your income.
