California law allows a spouse to include the elimination of spousal support in a prenuptial agreement.

However, at the time the agreement is signed, the affected spouse should be represented by an attorney.  If the spouse is not represented by an attorney at the time of signing, later on, down the road, the court may disregard that portion of the prenuptial agreement.
