Legal separation

Follow Us

A legal separation in California is when two people wish to remain married, live apart, and still have legal protection.  It is pursued when the couple wants to stay married for specific reasons, such as income tax, spousal support payments, benefits or religious reasons.

A legal separation involves a court order declaring that all issues concerning the marriage have been resolved.  The issues include child custody, child support, child visitation, spousal support, distribution of property, etc.

A legal separation does not mean that the parties can remarry; they have not been returned to the legal status of a single person as yet.  It does, however, leave the door open for a possible reconciliation of the marriage.

If you would like to pursue a legal separation or just have questions regarding one, contact an experienced Riverside Family Law attorney to discuss your case.
