Should I move out during a divorce?

A divorce is much more than just the end of a marriage.  It will change the rest of your life.

When a client asks if they should move out of the marital home while the divorce is going on, the answer usually is, “it depends.”  It is best to stay if possession of the home might be an issue.  The spouse who stays might argue that the spouse who left gave up the right to live in the house by departing in the first place.  Judges often give some consideration to this argument.
