What is a legal separation?

Married couples in California who want to live apart have the option to file for a divorce or legal separation.

A legal separation allows the parties to remain married, but ends the economic ties – allowing each to retain his or her earnings and be responsible for his or her own debts incurred after the separation.  Once you file for a legal separation, it can be converted to a divorce petition at a later date.

A legal separation gives the parties protection of the courts.  The process is similar to divorce, except the 90-day waiting period does not apply.  However, at the end of the process, the couple is still married.

There are major issues that need to be decided, which include property division, payment of debts, and spousal and/or child support if there are children involved.
