What is a marital settlement agreement?

A marital settlement agreement contains terms negotiated by the spouses and their attorneys regarding family issues that include child custody, spousal and/or child support, property division, debt responsibility, and visitation rights.

The final document is a written record that identifies all decisions that the couple have agreed on.  The agreement is incorporated into the final divorce judgment and represents a legal relationship of mutual obligations between the two individuals.  If any issues are violated, a party can be held in contempt of court.
