A postnuptial agreement is made after the marriage takes place – usually after there is a change of circumstances affecting one of the spouses.

Postnuptial agreements, a written contract to settle the couples affairs in the event of a separation, divorce or death, have become more and more common in the last few years since women have become more financially independent and are more concerned about preserving their assets, especially when there are children involved from a previous marriage.

Compared to a prenuptial agreement, it includes provisions for the division of property and assets in the event of a breakup.
