What is Early Neutral Evaluation?

Follow Us

The goal of early neutral evaluation is to position the case for early resolution by settlement, dispositive motion or trial.

The goals are to:

·     enhance direction communication between both parties

·     provide an assessment of the merits of the case

·     identify and clarify specific issues in dispute

·     facilitate settlement discussions

An informal meeting is usually held with an evaluator, both parties and their attorneys, and any necessary witnesses to the case. Each party presents evidence and arguments supporting his or her case.  The evaluator identifies areas of agreement and writes an evaluation of the situation.
