What is the waiting period for divorce?

A California divorce takes a minimum of six months.  This six-month period is known as the ‘waiting period’.

Once the papers are filed and served, the six-month ‘waiting period’ begins.  It gives you and your spouse a chance to change your mind about going through with the divorce; it allows you the chance to reconcile if you want.

Even if you and your spouse agree to all the issues in a short time, you must still wait for the six months to end before your divorce is final.  You are not free to remarry until the six months conclude.
